Terms of Service for the Arkham Horror Miskatonic Masquerade

 

The Arkham Horror Miskatonic Masquerade at the Wabasha Street Caves located at 215 Wabasha St S, St Paul, MN 55107 (“Event”) is owned and/or operated Asmodee North America, Inc. dba Fantasy Flight Games, Inc. located at 1995 County Rd B2 W, 55113, Roseville, MN (“FFG”).

Please read these Terms of Service (“Terms”) carefully.  By registering for and attending the Event, you acknowledge that you have read, understood, and agree to be bound by these Terms, including all of the warranties, indemnities, releases, and limitations of liability contained herein.

Registering on Behalf of Others: If you are registering on behalf of another attendee, it is your obligation to make sure that the attendee for whom you are registering is aware of these Terms and accepts them. By submitting the registration, you represent and warrant that you have made all attendees on whose behalf you are registering aware of and that they agree to these Terms.

If you do not wish to be bound by these Terms you should not register for or attend the Event. 

 

Except as explicitly otherwise provided herein, all sales are final.

 

Registration Required

Entrance to the event requires valid, prior registration. Registration is only valid for the individual(s) named in the registration submission.

 

You acknowledge and understand that FFG is granting you a revocable license (a personal and limited right) to attend and participate in the Event. The license is valid only for the Event and for the areas specified by FFG or the venue operator. FFG may revoke the license or deny admission without compensation for any reason, including, but not limited to, your attempted or actual violation of these Terms or for any action you take in violation of any local, state or federal law, or that may endanger other attendees.

Cost of registration is non-refundable and registration is non-transferable.  You may not resell your registration, except with the prior written approval from FFG.

 

Check In and Security

All attendees will be required to check in and provide valid identification matching the name provided during registration to be admitted to the Event. Attendees may be searched upon entering the Event. Personnel may inspect bags and other personal items and will deny entry with objects that FFG determines jeopardize the safety of other attendees or that may disrupt the Event. For that reason, please refer to the prohibited items list below before attending the Event.

 

Prohibited Items

FFG prohibits the following items at the Event:

  • Weapons or sharp objects (regardless of permit);
  • Prop weapons;
  • Props or costume components that shed, such as feather boas, glitter, and confetti;
  • Flammable objects;
  • Glass containers;
  • Animals (with the exception of service animals);  
  • Illegal substances;
  • Drugs or drug paraphernalia (excluding legally obtained prescription drugs in an approved container);
  • Any other items that FFG, in its sole discretion, deems pose a threat to the safety and enjoyment of the attendees.

 

If you bring any of the above prohibited items to the Event, you will not be allowed entry with the item. FFG reserves the right to add to this list at any time and confiscate any item that becomes a danger at the Event. Under no circumstances will FFG hold any confiscated prohibited items for attendee.
 

Event Conduct

This is a 21+ event designed for celebration, connection, and great music. We do not tolerate harassment of any kind. All attendees, including Event staff, are expected to comply with the following requirements:

  • Be kind, respectful, and inclusive;
  • No harassment or inappropriate behavior, on or off the dance floor;
  • No violence, threats, or verbal abuse;
  • Follow all venue rules, posted signage, and staff instructions;
  • Drink responsibly.

Attendees that violate these requirements will be asked to leave without a refund. We encourage attendees that experience improper conduct in violation of this policy to report it immediately to Event staff.

Privacy

You understand that this is a public event and agree that you have no expectation of privacy or confidentiality with respect to your conduct and actions at the Event  By Participating in the Event or by submitting information to FFG in connection with the Event, you agree to the terms of the Privacy Policy, located at https://www.fantasyflightgames.com/en/more/privacy-notice/ and which may be updated by FFG at any time. Continued participation in the Event shall constitute your acceptance of any such updated Privacy Policy.

 

Notice of Video Recording and Release

By attending the Event, you understand, agree and acknowledge that you may be photographed, filmed, or livestreamed and hereby provide FFG and the venue operator with absolute, express consent to be photographed, filmed, and livestreamed.

For good and valuable consideration, and in exchange for the opportunity to attend the Event, you grant FFG and its assigns, agents, and those acting with its permission (together, the “FFG Parties”), the absolute and irrevocable right to use recordings, audio, video, images, photographs, and/or other likenesses of you taken at the Event, (collectively and individually, “Information“), and to incorporate such Information into any FFG Parties promotional, marketing, informational, or other materials, including in, but not limited to, photographs, video recordings, electronic media, Internet web sites, and social media web sites and platforms (“FFG Materials“).

You acknowledge and agree that the FFG Parties may use, edit, reproduce, display, distribute, create derivative works of, and publish without restriction, in whole or in part, the Information and FFG Materials, in any current and future media, for any purpose. You acknowledge that FFG is not required to use the Information.

You waive all rights, claims, or interest, if any, that you now have or may later acquire with respect to any Information incorporated into or otherwise related to the FFG Materials, including any right to any compensation. You acknowledge no compensation will be offered or granted at any time before, during or after the use of the Information and FFG Materials. You release and agree to indemnify, defend, and hold harmless, FFG, its officers, employees, assigns, agents, and those acting with its permission, from all liability for any claims related to the Information and FFG Materials.

Any recordings made by attendees at the Event may not be used for commercial or public purposes, including, without limitation, having ads run on or beside such videos on YouTube and other video sharing websites. Non-professional grade small video cameras and cameras are allowed at the Event site.

 

Food and Drinks

No outside food, drinks, or alcohol may be brought to the Event. Attendees are prohibited from drinking or possessing alcohol except in areas designated by the venue.  FFG reserves the right to deny admission or entry, and to remove, ban or eject an attendee from the Event, without refund, liability or compensation, because of intoxication.

 

Cancellation Policy

FFG reserves the right to cancel or postpone the Event, or any part of the Event, on limited or no notice in FFG’s sole discretion. In the event of a cancellation or postponement of the Event, FFG shall not be responsible or liable for any costs, damages, fees, expenses or other compensation associated with the Event. Notwithstanding the foregoing, FFG may issue, at its sole and absolute discretion, a partial or full refund of the cost of your registration, by accounting for, among other things, the extent and nature of the cancellation.
 

Assumption of Risk; Limitation of Liability; Release

You acknowledge that there are potential hazards and risks of physical injury or illness incidental to participating in the Event and that not all risks can be fully eliminated. By attending the Event, you freely and voluntarily assume all risks which are incidental to the Event, regardless of severity, except to the extent caused by the gross negligence or willful misconduct of FFG or its agents. 

By attending the Event, you, on behalf of yourself and your heirs, executors,  administrators, successors, assigns, and representatives, expressly waive and release any and all claims, now known or hereafter known, against FFG, and its officers, directors, managers,  employees, agents, representatives, successors, and assigns (collectively, "Releasees"), on account of injury, disability, death, or property damage arising out of or attributable to your attendance at the Event, whether arising out of the ordinary negligence of FFG, its agents or employees, or any Releasees or otherwise. You agree not to make or bring any such claim against FFG or any other Releasee and forever releases and discharges FFG and all other Releasees from liability under such claims. This waiver and release does not extend to claims for gross negligence, willful misconduct, or any other liabilities that Minnesota law does not permit to be released by agreement.

You shall defend, indemnify, and hold harmless FFG and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees, fees, the costs of enforcing any right to indemnification under this release, and the cost of pursuing any insurance providers, arising out of or resulting from any claim of a third party related to attendee’s participation in the Event, including any claim related to attendee’s own negligence or the ordinary negligence of FFG.

 

Disputes

To the fullest extent permitted by applicable law, you agree that any disputes, claims, and causes of action arising out of or connected with these Terms will be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Minnesota or the appropriate state court located in Minneapolis, Minnesota. These Terms are governed by the laws of Minnesota, without regard to choice of law or conflict of law rules. You waive any and all objections to jurisdiction and venue in these courts and hereby submit to the jurisdiction of those courts.

You agree that any cause of action arising out of or related to participation in the Event must commence within one (1) year after the cause of action occurs. Otherwise, such cause of action is permanently barred. Nothing in these Terms shall be deemed to confer any third-party rights or benefits.
 

Severability

If any provision of these Terms is held void, invalid, inoperative, or otherwise unenforceable by a court of competent jurisdiction, then no other term or provision will be consequently affected, and the remaining terms and provisions will remain in full force and effect.

 

Entire Agreement; Incorporation; No Reliance

These Terms, including the terms incorporated by reference, constitute the entire agreement between FFG and you with respect to the subject matter.  To the extent permitted by the applicable law, FFG disclaims all warranties or conditions, either express or implied, or any part of them in respect of any aspect of the Event. You acknowledge and agree that in accepting these Terms they have not relied on any representation or warranty that is not expressly included in these Terms and agree that you shall have no remedy in respect of any misrepresentation which has not become a part of these Terms.
